Personal Computer Monitoring Terms of Service

1. Description and Acceptance of Terms of Service

SWS Electronics LLC (“SWS Computers”, “SWS”, “we”, “us”, “our”) provides PC support and computer services. By signing up or otherwise using our service you are entering into a binding contract with SWS Computers. Your agreement with us includes these Terms of Service (“Terms”) and our Privacy Policy (The Terms, Privacy Policy, and any additional terms that you agree to, are referred to together as the “Agreements”.) If you wish to review the terms of the Agreements, the effective version of the Agreements can be found on SWS Computers website. You acknowledge that you have read and understood the Agreements, accept these Agreements, and agree to be bound by them. If you don’t agree with (or cannot comply with) the Agreements, then you may not use the SWS Computers services.

2. Changes to the Agreements

SWS Computers may occasionally need to make changes to these terms for many reasons. You should review these Terms regularly, which are posted on the SWS Computers Website. If we make a material change to these Terms, we will notify you by posting a notice on the SWS Computers Website or by sending you an email. In some cases, we will notify you in advance, and your continued use of our services after the changes have been made will constitute your acceptance of the changes.  

3. Third Party Software

SWS Computer uses many Third-Party Software applications to perform our services. These Third-Party Applications may have their own terms and conditions of use and privacy policies. Your use of these Third-Party Applications will be governed by, and subject to such terms and conditions and privacy policies. You understand and agree that SWS Computers is not responsible or liable for the behavior, features, or content of any Third-Party Software or for any transaction you may enter into with the provider of any such Third-Party Software.

4. Description of Personal Computer Monitoring Service

The following services are provided to you by SWS Computers in accordance with this agreement. Each service is detailed as to accurately set your expectations.

  • a. Personal Computer Monitoring

    As a part of this agreement SWS Computers will install a Remote Monitoring and Management client on each personal computer that is a part of this agreement. This client allows SWS Computers to monitor, modify, and access many of the personal computer’s functions and features necessary to provide the services described in this agreement. It also functions as an advanced warning system that in some cases can help to spot a potential problem.   This client does not give SWS Computers direct access to any files, program data, etc. stored on the personal computer. SWS Computers will never access or make changes to a personal computer unless it is required to complete a service requested by you.
  • b. Anti-Virus & Anti-Spyware

    SWS Computers uses Windows Defender in conjunction with Malwarebytes and SUPERAntiSpyware to offer a robust security solution for you. The paid Premium versions of these products incorporate real-time infection removal, alerting, and reporting as well as scheduled daily scans of your personal computer. SWS Computers will provide the free versions of the software, which require your involvement for scanning and updating. SWS Computers can provide the paid Premium versions at an additional cost. If you prefer to use the provided free software, SWS Computers can provide a training course on how to use and maintain said software. In the case that you get a computer virus, malware, spyware, etc. SWS Computers will use these programs in an attempt to remove the threat as a part of this agreement. If a more serious threat is found on a personal computer it maybe be required to have the computer brought back to SWS for service. You may use your own preferred Anti-Virus software (i.e. McAfee, Norton, AVG, Kapersky), but SWS Computers will not support them. In the case of more substantial threats such as ransomware, key loggers, etc. SWS Computers will attempt to quarantine threats as soon as possible in an effort to stop any further harm to any of your personal computer(s). SWS Computers does not claim that these Anti-Virus programs will stop all threats, as it is still possible to get an infection even with Anti-Virus software. SWS Computers recommends following proper browsing habits to minimize this risk.
  • c. Remote Desktop Access

    Another component of the Remote Monitoring and Management client is Splashtop Remote Streamer. This application allows SWS Computers to remotely access a personal computer’s Windows environment (Remote Desktop Connect) and can be an essential tool used to resolve problems. Splashtop Remote Streamer utilizes TLS and 256-bit AES encryption to ensure all connections are secure. SWS Computers will never take over any of your personal computer’s unless it is needed to resolve a problem that you specifically requested SWS Computers to do so. Whenever SWS Computers connects to a personal computer using Splashtop Remote Streamer the personal computer will display a message stating that SWS Computers has connected to said computer.
  • d. Windows and approved application Patch Management

    SWS Computers schedules windows updates as well as Adobe and Java updates in an attempt to ensure that your personal computer(s) stay secure and up to date. The following objects can be updated automatically depending on the needs of the customer.

    • Windows Security updates
    • Windows Critical Updates
    • Service Pack updates
    • Microsoft Office updates
    • Java Updates
    • Adobe Updates

    SWS Computers does not create any of these patches or updates nor does SWS Computers have any input in them. SWS Computers simply installs updates and patches in an effort to decrease security risks, however there are times where an update or patch can cause problems. SWS Computers does not have control over this. If there is a known bad patch or update for any of the software that SWS Computers manages, we will make every effort to avoid that patch or update from being installed.

5. Rights you grant us

Under the Agreement you grant SWS Computers the right to use the processor, bandwidth, and storage hardware on your personal computer in order to facilitate the operation of the Personal Computer Monitoring Service.

6. Billing & Subscriptions

By providing a credit card accepted by SWS Computers (“Payment Method”) for your service you are expressly agreeing that we are authorized to charge you a periodic fee on a recurring basis corresponding to the term of your service and any applicable taxes to the Payment Method. If you want to use a different Payment Method than the one you signed up to use during registration, or if there is a change in your credit card validity or expiration date, you may edit your Payment Method information. This can be done by logging into the customer portal on the SWS Computer’s Website and viewing your account details.

If your Payment Method expires and you do not edit your Payment Method information as described above, or cancel your account, you authorize us to continue billing for services provided. You will remain responsible for any uncollected amounts.

As used in these Terms, "billing" shall indicate either a charge or debit, as applicable, against your Payment Method. The subscription fee will be billed at the beginning of your subscription, and on each periodic renewal date thereafter until you cancel your subscription or service is otherwise suspended or discontinued pursuant to these Terms.  You may review your billing period and the next date of billing by logging onto your account on the customer portal on the SWS Computers Website.

We automatically bill your Payment Method on the calendar day corresponding to commencement of your subscription. The interval of time between each payment due date shall correspond to the term of your subscription and be referred to herein as a "Billing Period.".  You acknowledge that the timing of when you are billed and the amount billed in each Billing Period may vary for reasons that include; but are not limited to changes in your subscription, changes in your Payment Method, and changes in applicable taxes. You authorize us to charge your Payment Method for the corresponding amounts.

SWS Computers reserves the right to change the terms of your subscription; including price, from time to time, effective at the beginning of your next Billing Period following the date of the change. If SWS Computers changes the subscription fee or other charges for your subscription, we will give you advance notice of these changes.

7. Cancellation of Service

Your subscription will continue in effect on a recurring basis corresponding to the term of your subscription until you cancel your subscription or the account or service is otherwise suspended or discontinued pursuant to these Terms. You must cancel your subscription before your next renewal date to avoid the next billing charge. SWS Computers will bill the periodic subscription fee plus any applicable taxes to the Payment Method registered to your account. If you cancel your subscription, cancellation will be effective at the end of the current Billing Period. This means that you will have continued access to your subscription for the remainder of that period, but you will not receive a refund. You can cancel your subscription by logging into your customer portal on the SWS Computers website.

8. Service Limitations

SWS Computers will make reasonable efforts to keep the Personal Computer Monitoring Service operational. However, certain technical difficulties may result in temporary interruptions. SWS Computers reserves the right to modify, discontinue temporarily, or permanently the Personal Computer Monitoring Service with or without notice, except where prohibited by law.
